Bittrex and Poloniex want law firm Roche Freedman LLP removed from certain class action lawsuits filed against them. The crypto boutique litigation firm filed class action lawsuits against several trading platforms in 2020, and the lawsuits allege that many centralized exchanges used Tether (USDT) to manipulate crypto prices.
However, Kyle Roche, Roche Freedman’s attorney and founding partner, removed himself from the lawsuit after a series of videoswere published by Crypto Leaks. In the video clips, Roche discusses his relationship with various crypto businesses.
The attorneyclaims that the clip contains “numerous unsourced false statements and illegally obtained and highly edited video clips that are not presented in an accurate context”. Despite Roche’s defense, he has decided to withdraw from several high-profile cryptocurrency lawsuits. Shortly after
Roche removed himself from the lawsuit, Elliot Greenfield, attorney for Debevoise &Tether, Debevoise &Plimpton LLP, requested that Roche’s entire firm be barred from the lawsuit. Now Poloniex and Bittrex are demanding the same thing, and they believe Roche’s statements and integrity may taint its actions, including the intent behind discovery.
“Mr. Roche’s recent statements raise serious concerns about the intent behind such discovery and how it may be used,” the Exchange’s attorneys wrote to the Southern District of New York presiding judge. The application adds.
While the Exchange defendants appreciate that a protective order has been entered in this matter and that their counsel can be expected to comply with such an order, Roche’s statements make clear that he is already using the confidential materials produced in the lawsuit for improper purposes.
Roche Friedman, on the other hand, believes that the allegations against Kyle Roche are “patently false” and that the litigation firm expected the defendant to use the dispute against the entire law firm.” Roche Freedman elaborates, “But of course the defendants are using it as a litigation tactic to disqualify the entire law firm.
